How to Claim Compensation for Delayed Flights in Europe

If you've ever had your travel plans disrupted by a flight delayed by three hours or more, you know just how much of a headache it causes. It's possible for a passenger in this situation to seek compensation for such a delay, but airlines have historically argued with passengers about whether the flight's actual arrival time is when the wheels hit the ground, or when the aircraft doors open.

The European Court of Justice recently cleared up this dispute, ruling that a flight's actual arrival time is, in fact, defined by the time when at least one aircraft door is open. This means that, even if a plane arrives less than three hours late but waits on the tarmac long enough, it's still late enough for passengers to seek compensation anywhere in the range of $160 to $800 per person.

Although anybody who travels on a flight operated by an EU–regulated airline, regardless of destination, is eligible for flight-delay compensation regardless of citizenship, only an estimated five percent of eligible passengers pursue a claim, says Marek Janetzke, the managing director of Berlin-based flightright, a company that fights for compensation on behalf of passengers whose European flights are delayed or canceled.

Pursuing a claim is actually much easier than it sounds. Passengers who have determined that the aircraft doors opened at least three hours behind schedule can visit flightright's website and enter their flight number, and flightright will take care of the rest, including filing all paperwork and representing the passenger in court. The company charges nothing up front to pursue the claim, and after it's settled, flightright sends the passenger a check for the full amount of the compensation paid by the airline, minus a contingency fee of 25 percent.

"If your claim is unsuccessful, you pay nothing," Janetzke says. "However, we have a 98 percent success rate." That high success rate, coupled with the fact that you can file a claim up to four years after the delayed flight, means it's the perfect time to go back through your travel records and investigate whether you can get compensation for a stressful delay you've experienced.

Keep in mind that you won't win a claim when the airline is not to blame for the delay or cancellation. So strikes and bad weather won't get you compensation, even though they may have created problems for your schedule. But if your flight was disrupted because of equipment malfunctions or the airline being ill-prepared for bad weather while other flights ran on time, then consider pursuing a claim—you might be able to get a few hundred dollars out of it.

It's On: National Review, 22 Conservatives Openly Denounce Trump


Escalating a skirmish into combat, the conservative magazine puts a beating on the GOP's front-runner.

All-out war has erupted between conservatives and the Republican establishment over presidential front-runner Donald Trump and Ted Cruz, his closest challenger.

Just as party elites have begun to grudgingly coalesce behind the billionaire real-estate mogul – or at least against the Texas senator, a brash tea-party favorite – the conservative magazine National Review is leading the charge against the businessman, publishing on Thursday evening a blistering editorial and a collection of essays "Against Trump" from 22 influential figures on the right.

"He is not deserving of conservative support in the caucuses and primaries," the National Review's editorial board wrote. "Trump is a philosophically unmoored political opportunist who would trash the broad conservative ideological consensus within the GOP in favor of a free-floating populism with strong-man overtones."


The editorial board called Trump and his campaign "show and strut," said his plan to force Mexico to pay for a wall on the U.S. border "silly bluster" and slammed his call to deport 11 million people as a "herculean administrative and logistical task beyond the capacity of the federal government."

Instead of embracing core conservative principles, Trump "has shown no interest in limiting government, in reforming entitlements, or in the Constitution," they wrote.

The likes of radio host Glenn Beck, former RedState.com editor Erick Erickson, Weekly Standard editor Bill Kristol and Club for Growth President David McIntosh piled on.

"When conservatives desperately needed allies in the fight against big government, Donald Trump didn't stand on the sidelines. He consistently advocated that your money be spent, that your government grow, and that your Constitution be ignored," wrote Beck.

"He's effectively vowing to be an American Mussolini, concentrating power in the Trump White House and governing by fiat," wrote David Boaz, executive vice president of the Cato Institute. "It's a vision to make the last 16 years of executive abuse of power seem modest."

The Republican National Committee immediately responded by disinviting National Review from sponsoring a Feb. 25 Republican primary debate.

RNC communications director Sean Spicer explained the move, saying that a debate moderator can't have a predisposition for or against any of the candidates.

"Going after each other in the long run is not helpful for the party," Spicer said on CNN Friday. "I would rather see that energy focused on Hillary Clinton."

The magazine brushed off the slight.

"We expected this was coming," said National Review publisher Jack Fowler. "Small price to pay for speaking the truth about The Donald."

As for the candidate himself, Trump responded to the magazine's attack in typical fashion.

"The National Review is a dying paper," he said at a press conference in Las Vegas Thursday night. "Its circulation is way down. Not very many people read it any more – people don't even think about the National Review."

Vaccine Efforts Underway as Zika Virus Spreads

Alarmed at the surge of Zika virus in the Americas, the U.S. government has launched an effort to develop a vaccine.

"We're already starting on it," says Dr. Anthony Fauci, director of the National Institute of Allergy and Infectious Diseases. But while workers at the institute's Vaccine Research Center are armed with lessons learned from working to counter West Nile virus, chikungunya virus and dengue fever, Fauci says developing a vaccine for Zika will require "an extensive research and development effort."

The Pan American Health Organization now says the virus has spread to more than 20 countries and territories, and Brazil has reported that more than 3,800 babies have been born with microcephaly – a condition believed associated with the virus that involves a small cranium and brain and can lead to lifelong cognitive impairment.


"No matter how you slice it, with a twentyfold increase in microcephaly – to 3,800 cases at last count – that's a serious issue," Fauci says. "We've got to do something about it."

In addition, the virus appears to be linked to a rise in a nerve ailment called Guillain-Barre syndrome that causes paralysis in adults. "El Salvador usually reports an average of 14 cases a month," says Dr. Marcos Espinal, the Pan American Health Organization's director of communicable disease programs. "Between December and January, they reported 46 cases."

So far, public health efforts to curb the mosquito-borne Zika virus have focused on avoidance, with Brazil and El Salvador urging women to hold off on getting pregnant. For its part, the U.S. Centers for Disease Control and Prevention is urging pregnant women to avoid traveling to a lengthening list of affected areas – updated Friday to 22 destinations – and all travelers to follow strict precautions to avoid mosquito bites.

With a handful of Zika infections reported in travelers returning to the United States and with others undergoing testing, some U.S. public health officials are concerned that the virus may gain a toehold in the country. The most likely locations are along the Gulf Coast and in Florida, though Fauci and others say an extensive spread is unlikely.

"We're unlikely to have serious local spread," Fauci says. "This is very similar to dengue, where it laps at our shores, people get infected in other regions and come back to the United States. Will local cases turn into major outbreaks? I don't think so. There have been millions of cases of dengue in South America and the Caribbean for years and years."

That doesn't mean, Fauci says, that the U.S. shouldn't be concerned, because two mosquitoes that carry Zika – Aedes aegypti and Aedes albopictus mosquitoes – are found in the Southeast, and local outbreaks may occur. "I think we're very likely to see a large number of imported cases as a lot of people go to South American and the Caribbean and come home," he says.

The consequences of becoming infected are so dire, researchers say, that developing a vaccine must be an urgent priority. "Everywhere and anywhere there's vulnerability, there's pressure for a vaccine," Fauci says.

The virus spreading globally is a real possibility, says Waleed Al-Salem, a researcher at the Liverpool School of Tropical Medicine and an adviser on insect-borne diseases to the Saudi Arabia Ministry of Health. Aedes aegypti mosquitoes, he says, are widely distributed in Southeast Asia, southern India, Pakistan, most African countries, the Arabian Peninsula, southern Europe and most Latin American countries.

Either the mosquito or an infected traveler can carry the virus to another country, and opportunities for global transmission abound. Next month, Carnival celebrations begin in Brazil, which typically are a major draw for globe-trotting travelers. This summer, Brazil is to host the Olympics. In eight months, millions of Muslim travelers from around the world – including from Latin America – will converge in Mecca, Saudi Arabia, for the annual hajj pilgrimage.

"Every year, 2 to 3 million people travel to Mecca," Al-Salem says. "Some of them may have Zika."

He notes the Saudi Ministry of Health takes precautions to prevent obviously ailing hajj pilgrims from infecting others and steps up mosquito-control efforts.

"Mosquito control is extremely important. If you don't get bitten, you don't get Zika," says Dr. Stanley Plotkin, professor emeritus at the University of Pennsylvania and developer of the rubella vaccine.

The rapidity of Zika's spread, Plotkin says, suggests there's a significant amount of virus in an infected person's blood. "That means a mosquito biting someone is very likely to become infected and transmit the virus to others," he says.

Yet mosquito control is only part of the solution, given how widely the insects breed and how difficult it is to wipe them out. A vaccine offers a more permanent solution, Plotkin says, but developing one will likely take years. Many scientific questions must be answered first.

Perhaps the biggest is whether people who have been infected with Zika virus are immune to re-infection from another mosquito bite after they recover. "If they are, a vaccine is likely to work," Plotkin says. "If they're not, we're in trouble."

Another key question is what sort of vaccine to create. It's risky to give pregnant women a vaccine made of live, weakened virus because they are more vulnerable to infection, which also places their fetus at risk, Fauci says. One approach he envisions is a laboratory construct made of DNA with a Zika virus "insert."

Big pharmaceutical companies so far have announced no plans to develop a vaccine. Merck – maker of a measles, mumps and rubella vaccine, among others – did not respond to a request for comment. And so far, pharmaceutical giant Pfizer is "not in the hunt for Zika," spokesman Dean Mastrojohn says.

The National Institute of Allergy and Infectious Diseases also plans to boost funding to Brazilian grantees to jump-start research efforts. "That's the fastest way to get them to work on diagnostics and vaccines," Fauci says. "We need better diagnostics so that women who are pregnant will know, and not have to guess, whether they're infected."

TSA to Expand PreCheck to 100 Airports in 2013



The Transportation Security Administration announced a major expansion of their expedited passenger screening program—TSA PreCheck—to have 100 airports configured with the offering by the end of the year. Currently only 40 airports have the PreCheck lanes. Many of those airports will also see an increase in the number of resources dedicated to the expedited screening service.

Passengers in the PreCheck lanes are able to pass through the screening checkpoint without removing their shoes or items such as laptops or liquids from their carry-on bags, though limits on liquid quantities and other items still apply. The process is significantly faster than the regular screening and is quite similar to the screening process from pre-2001 days. For passengers who are eligible to access the PreCheck screening it is a significant time saver at the airport relative to the regular screening.

PreCheck is also limited in access, however, meaning not all passengers can get in to those lanes. Currently only Alaska Airlines, American Airlines, Delta Air Lines, Hawaiian Airlines, United Airlines, US Airways, and Virgin America are participating in the program; JetBlue and Southwest are expected to join later this year. And just having the airline participating is no guarantee. Access is limited to members of a Trusted Traveler program such as Global Entry or NEXUS or to members holding elite status in the airline loyalty programs. Later this year the TSA will be introducing an option for passengers to enroll in the program directly, albeit for a fee.

And just because a passenger is eligible for PreCheck doesn't mean that they will get it every time they go to the airport. As the TSA notes in their release, "TSA will always incorporate random and unpredictable security measures throughout the airport. No individual will be guaranteed expedited screening."
